United States Eleventh Circuit

HORSLEY v RIVERA, 01-15821

An allegedly defamatory statement made during a television program, that an anti-abortion activist was an "accomplice to homicide", is protected under both the First Amendment and Georgia law as an imaginative and figurative expression that could not have been taken by a reasonable viewer of the Program as a literal assertion of facts.
