ANDERSON v. H&R BLOCK, INC., 01-11863

While sections 85 and 86 of the National Bank Act may provide a defense to state-law usury claims, these provisions do not accomplish complete preemption of plaintiff's complaints that defendants charged excessive interest in violation of Alabama Code section 8-8-1 and the common-law usury doctrine so as to permit removal; reversed and remanded to the district court.
