NAT'L R.R. PASSENGER CORP. (AMTRAK) v. ROUNTREE TRANSP. AND RIGGING, INC., 00-13811, 00-13986

In a multi-faceted appeal involving the collision of a passenger train with a hauler rig transporting a combustion turbine, the court: 1) affirmed rulings regarding restricted evidence and directed verdict as to the amount of damages insurance company had proven; 2) held that transport of a combustion turbine is inherently dangerous as a matter of Florida law; and 3) certified three questions to the Florida Supreme Court regarding state law sovereign immunity.
