United States Eleventh Circuit
ARAWAK AVIATION, INC. v. INDEM. INS. CO. OF N. AM., 00-14209
Where plaintiff's pilot negligently failed to secure an oil cap on an aircraft, causing the engine to lose oil pressure and severely overheat, the damage was excluded from insurance coverage because the damage was deemed to have directly resulted from "normal wear and tear" and "excessive heat," and not negligence.
