SKRTICH v. THORNTON, 00-15959

Prison guards who beat a prisoner in custody when he is incapacitated and no longer able to pose a threat to the guards' ability to maintain order, resist the guards' directions, or engage in disruptive behavior are not entitled to qualified immunity.
