BELLSOUTH v. TOWN OF PALM BEACH, 99-14272
Section 253(a) of the Telecommunications Act of 1996 contains the only substantive limitations on state and local government regulation of telecommunications, and subsections (b) and (c) are "safe harbors" functioning as affirmative defenses to preemption of state or local authority that would otherwise violate (a).
