A regulation may be upheld based upon the agency's authority under U.S.A., Inc. v. Natural Resource Defense Council, Inc., 467 U.S. 837, to resolve statutory ambiguities when the agency had stated upon issuance of the regulation that the statute was not ambiguous at all.
