United States Tenth Circuit
Kaufman v. Am. Family Mut. Ins. Co., 08-1491
In plaintiff's counsel's appeal from the district court-s order imposing sanctions against them for discovery misconduct, and the district court-s refusal to order discovery into the extent of ex parte communications between defense counsel and the court, the order is affirmed where 1) the district court was not required to expressly enumerate each and every act prohibited by the protective orders it issued even when such prohibited acts were obvious from the context of the litigation and the context in which the orders were issued; 2) counsel's attempt to characterize its solicitation of clients as political expression or association was unavailing; and 3) any ex parte communications between defense counsel and the court regarding the merits of the litigation would have prejudiced, if anyone, plaintiff as the litigant and not her counsel.
