US v. Martinez, 09-1140

Defendant's bank robbery sentence is affirmed in part where the district court did not err in finding that defendant made a threat of death during the bank robberies and enhancing the sentence accordingly. However, defendant's sentence is remanded because a state court vacated one of defendant's prior convictions.
