United States Tenth Circuit

Attorney Gen. of Okla. v. Tyson Foods, Inc., 08-5154

In an action against a food producer for violation of various environmental laws, the denial of a preliminary injunction is affirmed, where Plaintiffs failed to link the poultry waste produced by Defendant with potentially harmful bacteria, and the District Court did not abuse its discretion by excluding certain expert testimony as unreliable.
