Burnett v. Southwestern Bell Tele., L.P., 07-3126
In an action against defendant-former employer raising retaliatory discharge claims under the Family and Medical Leave Act (FMLA) and ERISA, summary judgment for defendant is summarily affirmed where plaintiff's failure to include in her appendix documents controlling the resolution of the issues on appeal (i.e. the evidence she presented to the district court in an effort to demonstrate genuine issues of material fact) deprived her of the right to challenge the judgment of the district court.
