US v. Cosby, 08-2088
A sentence for possession with the intent to distribute crack cocaine is affirmed where the district court properly considered a prior departure for substantial assistance defendant provided to law enforcement in later deciding not to further reduce defendant's sentence based on amendments to the Sentencing Guidelines that reduced the penalty for offenses involving crack.
