United States Tenth Circuit

State Farm Mut. Auto. Ins. Co. v. Boellstorff, 07-1241

The circuit court predicts that the Colorado Supreme Court would apply the class action tolling doctrine, originally announced in American Pipe & Constr. Co. v. Utah, 414 U.S. 538 (1974), to toll the statute of limitations for otherwise-stale individual claims filed before a class certification decision.
