Smith v. Rockett, 06-6331

In an action alleging a violation of the Fair Debt Collections Practices Act and also raising state law claims, dismissal of plaintiff's complaint for lack of standing is reversed as Chapter 13 bankruptcy debtors, such as plaintiff, have standing to bring claims in their own name on behalf of the bankruptcy estate.
