United States Tenth Circuit

Ismaiel v. Mukasey, 06-9588

In asylum proceedings brought by Syrian native claiming that he would be persecuted on account of his political opinion if he was returned to his home country, petition for review of denial of relief is denied where: 1) the BIA could properly find that petitioner had failed to satisfy his burden of persuasion that he faced persecution or torture in Syria; and 2) he forfeited an argument that a remand was required due to a failure to consider a claim that the Syrian government believes petitioner to be a supporter of the Muslim Brotherhood and routinely imprisons and tortures members of that group.
