Somoza v. Univ. of Denver, 06-1488
In two university professors' action raising various federal and state law claims against defendants involving alleged discrimination on the basis of their race/national origin, summary judgment for defendants is affirmed where, despite testimony that plaintiffs endured various instances of incivility, rudeness, and allegedly offensive statements regarding their ethnicity and national origin, they did not show that summary judgment was in error under the standard articulated in Burlington Northern & Santa Fe Ry. Co. v. White, 126 S. Ct. 2405 (2006).
