United States Tenth Circuit

US v. Romero, 07-1298

An order denying defendant's request for an immediate determination of whether any revoked supervised release time should run concurrently with his state prison sentence is affirmed where: 1) the order was final for purposes of jurisdiction under the collateral order doctrine; but 2) a decision, to wait to hold a hearing to determine whether defendant violated his supervised release until after he completes his state court confinement, was not unreasonable and did not violate due process.
