United States Tenth Circuit
Weyerhauser Co. v. Wyatt, 06-7096
In a federal suit brought by a mill operator to enjoin state court proceedings for breach of contract against it by a former employee, dismissal of the suit is reversed and remanded as: 1) the Anti-Injunction Act did not deprive the court below of authority to enjoin the state proceedings because the parties actually litigated and the district court decided the claim for breach of contract in prior litigation; and 2) the district court erred in granting the dismissal motion.
