Darr v. Town of Telluride, Colorado, 06-1227
In a 42 U.S.C. section 1983 case brought arising from defendant-town's termination of plaintiff-deputy marshal, summary judgment for the town is affirmed as: 1) the town consitutionally revised its old policies; 2) plaintiff could not subject the town to liability under section 1983 for acting negligently; 3) he lacked a substantive-due-process right in continued employment; and 4) his employment manuals did not amount to contracts with the town.
