Lane v. Simon, 05-3266
In a suit by former editors of a daily newspaper affiliated with Kansas State University against school administrators alleging that the removal of the paper's advisor violated their First and Fourteenth Amendment rights, dismissal of the suit under Rule 12(b)(6) is vacated and remanded to the district court with instructions to dismiss as moot since the plaintiffs have graduated and no longer serve on the paper's board.
