United States Tenth Circuit
US v. Nevels, 06-1240
Defendant's conviction and sentence for firearm possession is affirmed over meritless claims that: 1) the disclosure of a government witness's existence three days prior to trial denied him a fair trial; 2) introduction of expert testimony describing how he shot and killed an individual in his home was unfairly prejudicial in a firearms possession trial; and 3) the district court erred in determining that one of his prior juvenile delinquency adjudications constituted a predicate offense under the Armed Career Criminal Act (ACCA).
