United States Tenth Circuit
Smith v. US Court of Appeals for the Tenth Circuit, 04-1468, 04-1470
In lawsuits stemming from the denial of plaintiff's application for admission to the Colorado bar, dismissal of the suits is affirmed where: 1) the district court properly found that plaintiff lacked standing for his challenge to the state court's use of non-precedential unpublished decisions to dispose of appeals; 2) he also lacked standing for his challenge to the federal non-publication rule; and 3) a petition for mandamus relief against a state trial judge was properly rejected.
