United States Tenth Circuit
de Silva v. Pitts, 06-7046
A judgment denying petitioner's Hague Convention petition for return of her son to her custody in Canada, and instead allowing him to remain with his father in Oklahoma pending a custody determination, is affirmed where, under the unusual circumstances of the case, it was appropriate to refuse repatriation to Canada solely on the basis of the son's desire to stay in Oklahoma.
