Jencks v. Modern Woodsmen of Am., 05-5130

In a lawsuit alleging plaintiff was denied an opportunity with defendant-company in retaliation for her earlier victory in a Title VII case against it, summary judgment for defendant is affirmed where, even if a prima facie case of retaliation had been made, defendant's reliance on an a settlement agreement between the parties was a legitimate, non-discriminatory reason for its acts which plaintiff failed to rebut with a sufficient showing of pretext.
