Adair Group, Inc. v. St. Paul Fire & Marine Ins. Co., 05-1350
In an action brought by plaintiff seeking indemnity under a commercial general liability insurance policy for an arbitration award in a construction defect matter, summary judgment for the insurer on the issue of coverage is affirmed where the deficient performance of plaintiff's subcontractors was not in itself an "event" triggering application of the insurance policy.
