US Fax Law Ctr., Inc. v. IHire, Inc., 05-1325

Dismissal of lawsuits brought by plaintiffs seeking damages for unsolicited faxes under the Telephone Consumer Protection Act (TCPA) is affirmed where plaintiffs lacked of standing because the underlying assignment of TCPA claims to them was invalid. However, contrary to the lower court's finding, diversity jurisdiction is available for TCPA claims.
