United States Tenth Circuit

A judgment in a Title VII case in favor of a former senior member of the Kansas Department of Human Resources, who was fired by the Secretary of the Department, is affirmed pursuant to a finding that she was not appointed by an elected official, and consequently, she was not subject to the policy maker exemption to Title VII and her discrimination claims were properly considered by the jury.
