US v. Guerrero, 1D06-3123
In a search-and-seizure case where there was no traffic stop and instead defendant was parked at a gas station when nearby police began questioning him, his conviction for drug-related offenses is affirmed over a claim of erroneous denial of a suppression motion as: 1) the detention was supported by reasonable suspicion, and thus it neither violated the Fourth Amendment nor tainted the search that followed it; and 2) a search of the vehicle was consensual.
