United States Tenth Circuit

Hammon v. Ward, 05-6158

Denial of a habeas petition challenging convictions for possession of a controlled dangerous substance, and firearms-related offenses is vacated and remanded for an evidentiary hearing where petitioner made sufficient allegations to merit the opportunity to present evidence in support of his habeas claim concerning his counsels- inadequate representation due to a conflict of interest and a failure to raise that claim on appeal.
