United States Tenth Circuit

U.S. v. Abdush-Shakur, 05-3147

Conviction for attempted murder and possession of a handmade knife by a prison inmate is affirmed over defendant's arguments that: 1) the trial court's denial of his motion to dismiss the indictment violated the Speedy Trial Act and his Sixth Amendment and Due Process rights; 2) the trial court erred by excluding the testimony of his expert witness; 3) the trial court should have his granted his request for the production of documents under Federal Rule of Criminal Procedure 17(c); and 4) the prosecutor excluded potential jurors based on race in violation of Batson.
