United States Tenth Circuit
Abiodun v. Gonzales, 05-9585, 05-9603
The BIA's dismissal of an appeal from an IJ's order of removal and its denial of a motion to reopen are affirmed where: 1) signing an oath of allegiance during a naturalization examination is insufficient to confer citizenship; 2) removal proceedings are not a proper forum to attack either the denial of an application for naturalization or a state-court conviction; 3) there was no record support for a claim of falsification; 4) a challenge to a detainer or detention during removal proceedings need not be considered; and 5) the court lacked jurisdiction over a challenge to a determination that appellant abandoned an asylum claim.
