In a suit against defendant Sam's Club for discrimination in violation of the Age Discrimination in Employment Act (ADEA) for its failure to promote plaintiff to general manager, denial of motions for judgment as a matter of law for defendant prior to a jury verdict and award for plaintiff are affirmed over claims that plaintiff failed to prove that he was qualified for a promotion and that his complaint was timely filed.
