United States Tenth Circuit

Prier v. Steed, 05-3251

An appeal from a declaratory judgment that a former sheriff's office employee is prohibited from carrying a firearm under federal law following a conviction for disorderly conduct by fighting is dismissed where plaintiff had dismissed with prejudice an underlying Family Medical Leave Act (FMLA) claim, and thus, no justiciable case or controversy existed and the case was now moot.
