United States Tenth Circuit

Burrell v. Armijo, 03-2223

Dismissal of a civil rights action against an Indian tribe and officials alleging that they intentionally ran plaintiffs off their farm, stole their crops, terminated their lease, and discriminated against them on account of their race, is reversed in part where a district court should not have given preclusive effect or otherwise recognized a tribal court's ruling which found that the tribe and named tribal officials were entitled to sovereign immunity.
