Opala v. Watt, 05-6261

In a suit brought by a state supreme court justice against colleagues claiming age discrimination in violation of the Equal Protection Clause and that his due process rights were violated when his colleagues on the Oklahoma Supreme Court changed a rule of rotation for elevation of a Chief Justice, denial of defendant's motion to dismiss is reversed where no prospective equitable relief could redress plaintiff's alleged injury.
