United States Tenth Circuit
Hornsby v. Jones, 05-5201, 05-5222
In a pro se prisoner's civil rights case, judgment in favor of defendants and an order denying plaintiff's motion to vacate the judgment are affirmed where, although the district court erred in applying Eleventh Amendment immunity to plaintiff's equitable claims, the error was harmless because plaintiff failed to state a legally viable claim for relief.
