US v. Flowers, 04-3206

In the context of criminal sentencing enhancements for previous convictions, 21 U.S.C. section 851(a)(1), which requires the government to serve an information on defendant stating such previous convictions, is a claim-processing rule and not a jurisdictional rule, and thus, claims of error under the rule may be forfeited.
