United States Tenth Circuit

Gonzales v. Martinez, 03-1348

The district court erred when it concluded that plaintiff-inmate failed to meet her burden of establishing a constitutional violation where the evidence presented, that jail officials knew of the substantial risk of physical harm to prisoners in their facility and failed to take reasonable measures to prevent recurrence, was sufficient to survive summary judgment.
