ALLSTATE INS. CO. v. MURRAY MOTOR IMPS. CO., 02-1500

The auto dealership's insurer was the primary insurer for the accident involving the service manager while driving one of his employer's "loaner vehicles" home for the evening; under Colorado's initial-permission rule, the service manager was a permissive user. Thus the dealership's insurer must reimburse plaintiff, who insured the manager under a personal policy, for costs arising from the accident.
