United States Tenth Circuit
DOMINION VIDEO SATELLITE, INC. v. ECHOSTAR SATELLITE CORP., 03-1274, 03-1303
District court erred in preliminarily enjoining defendant pending arbitration of this contract dispute. Though the parties agreed that any breach of the exclusivity provision would constitute irreparable harm and warrant an injunction, that alone is insufficient to support an irreparable harm finding.
