SOSKIN v. REINERTSON, 03-1162

Procedures used to implement a new Colorado law terminating Medicaid benefits to 3,500 aliens violate the Medicaid Act insofar as they deny some members of plaintiff class a right to a hearing. Defendant must be preliminarily enjoined from terminating benefits for failure to return redetermination forms unless notice was given of the right to request a pre-termination hearing.
