Plaintiff hospitals challenging interpretation of a Medicare Act provision are not entitled to mandamus jurisdiction as they failed to show that the Secretary of Health and Human Services owed them a clear, non-discretionary duty under the mandatory or discretionary reopening regulations of the mandamus statute, 28 U.S.C. section 1361.
