CARGLE v. MULLIN, 01-6027/41

Petitioner is entitled to relief from capital convictions and death sentences based on ineffective assistance of counsel and prosecutorial misconduct, but because sufficient evidence supported convictions and death sentences, the state may retry and resentence petitioner within a reasonable time without being constrained by double jeopardy concerns.
