United States Tenth Circuit

REVILLA v. GIBSON, 00-6244

Where the defendant's continuing course of pre-murder abuse of the victim was admissible to show the conscious suffering required for the heinous, atrocious, or cruel aggravator, and the jury's finding of a continuing threat on the basis of the callousness reflected in the defendant's abusive conduct toward the victim was supported, habeas relief denied.
