Where a suspect suffers from diminished mental capacity apparent to law enforcement officers, whether intoxication, a discernible mental condition or any other situation where use of the "hog-tie" restraint presents a significant risk to the suspect's health or well being, the individual's condition mandates the use of less restrictive means for physical restraint.
