Exxon Corp. & Exxon Texas, Inc. v. Emerald Oil & Gas Co., LC, 05-0729

In an action involving oil and gas dispute, court of appeals' judgment that section 85.321 of the Texas Natural Resources Code imposes a duty on current lessees to future lessees and thus provide a basis for a cause of action against Exxon, is reversed and remanded as, section 85.321 creates a private cause of action that does not extend to subsequent lessees, and here, because the plaintiff owned no interest in the mineral leases when the prior lessee allegedly damages the interest, the plaintiff lacks standing to assert a cause of action under section 85.321.
