Christie Bay Temple v. GuideOne Specialty Mut. Ins. Co., 09-0683

In a church's suit against its insurance carrier for breach of contract, the court of appeals' affirmance of the trial court's dismissal of the suit on the ground that the church lacked capacity because it was a non-profit corporation which had lost its charter is reversed and remanded as, there is no evidence that the church ever functioned as a corporation or otherwise lacked capacity to sue its insurance carrier for breach of contract.
