Supreme Court of Texas

In re Scheller, 09-1072

A father's request for mandamus relief from trial court's temporary orders for access to and possession of his children, arising from the grandfather's suit for grandparent access, is conditionally granted and the trial court is directed to lift the temporary order permitting grandparent access where: 1) the trial court abused its discretion in issuing the temporary orders for grandparent access, as the grandfather did not meet the burden required to divest the parent of control and autonomy in making parenting decisions; but 2) the trial court did not err in appointing an expert to serve as guardian ad litem to the children and as a psychologist to evaluate the case and make recommendations to the court regarding the children's best interests.
