Aquaplex, Inc. v. Rancho La Valencia, Inc., 08-0280
In plaintiff's case arising from a joint venture dispute involving property development, court of appeals' judgment is affirmed in part and reversed in part where: 1) some evidence supported an award of damages for fraud under the memorandum of settlement agreement, but not at the level awarded by the trial court; 2) the portion of the court of appeals' judgment rejecting defendant's declaratory and injunctive relief is affirmed; and 3) the portion of the court of appeals' judgment related to the monetary damages is reversed.
