In a health care liability suit brought against defendant-owner and operator of medical facility, petition to review decision finding expert report to be deficient is granted and lower court's judgment is reversed where: 1) when a party's alleged health care liability is purely vicarious, a report that adequately implicates the actions of that party's agents or employees is sufficient; and 2) to the extent petitioners alleged that respondent was liable only vicariously for the doctor's actions, the expert report requirement was fulfilled as to respondent if the report was adequate as to the doctor.
